“Blatantly unconstitutional” Judge Coughenour stated, Thursday citing that the 14th amendment which guarantees citizenship to anyone born on U.S. soil. He also stated he couldn’t recall a case where an action violated the constitution.
This has also prompted five lawsuits by 22 states and multiple immigration rights organizations.
According to @thehill the states that filed argued “The President has no authority to amend the Constitution or override the Citizenship Clause’s guarantee of citizenship to individuals born in the United States. Nor is he empowered by any constitutional provision or law to determine who is or isn’t granted U.S. Citizenship at birth.”
Brett Shumate of the Department of Justice disagreed with the actions, arguing that the rush for an emergency pause was unnecessary due to the fact the order won’t go into effect until Feb. 19th. He also requested an opportunity for a full briefing on the case’s merits.

Among the agreements under review involve two police reforms in Kentucky and Minnesota. Where both Breonna Taylor and George Floyd cases took place. Both cases will need Judge’s approval to take effect.
During Trump’s first term, the Justice department was limited in the use of consent decrees, this will change in his second term which is led by conservative attorney Harmeet Dhillon.
